We examine the issues concerning the legality and ethicality of the Second Amendment right to bear arms balanced by the employer's duty to provide a safe workplace for its employees. Two court rulings highlight this balancing act: McDonald et al. v. City of Chicago et al. and District of Columbia v. Heller. “Stand Your Ground” and “Castle Doctrine” laws in the recent Trayvon Martin shooting on February 26, 2012 are also applicable. Various ethical frameworks examine the firearms debate by viewing (...) the Second Amendment from three perspectives. These include a pro‐gun perspective drawing upon libertarianism and fundamental rights; a moderate gun perspective drawing upon consequentialism and stakeholder theory; and finally, an anti‐gun perspective drawing upon a Public Health Ethics and peace ethics approach. We explore the issue of gun control from a business perspective as employers face ethical decisions in responding to legislation that allows guns in the workplace and/or in employer parking lots while still being responsible to provide a safe workplace for their employees. We make recommendations regarding how companies should manage by proactively avoiding legal challenges to employees' rights to own and carry guns into the workplace. This includes emphasis on enhanced security, Human Resource policies and monitoring rapidly changing laws. (shrink)

In this short think-piece we trace the newly emerging and rapidly expanding dimensions and dynamics of the “neuro-complex.” What this amounts to, we suggest, are a series of bio or neuro “convergences” of sorts regarding the brain and mental worlds, which in turn are traceable through what we term the bio-psych, pharma-psych, subjectivity-selves, wellness-enhancement, and the neuroculture-neurofutures relational nexuses. These issues are then illustrated through two brief case studies regarding brain scanning technologies and the problems and prospects of cognitive enhancement. (...) Most patterns of an organism develop reproducibly and predictably. Thus, most biological patterns are largely predetermined by the nature of the zygote and by the nature of the surrounding world. Some ontogenetic patterns can also be considered to be preformed. Eighteenth and nineteenth century definitions of 'preformation' suggested that all aspects of a precursor pattern--its elements and its configuration--are preserved during development. Today, the idea of preformed configurations has been lost. To revive this lost idea, we offer the following biologically (...) contemporary definition for preformed ontogenetic patterns: preformed patterns are those patterns with topologies that have been conserved during their ontogenies. Pp. 256, Index.In The Sunflower Forest, William Jordan presents the process of ecological restoration as a new environmental paradigm for a "new kind of environmentalism" which will be "adequate (...) to the task of ensuring the survival of the world's natural landscapes or of providing the basis for a healthy relationship with them" (p. 3). It is unfortunate that this overall vision for the process of ecological restoration (if not for the argument of the book) begins with an equivocation on the task of this new environmental paradigm—is the task of ecological restoration to ensure the survival of natural landscapes or is it merely to provide humans with a healthy relationship with these landscapes? Jordan, who for many years was in charge of publications and public outreach at the University of Wisconsin Arboretum (a leading research center in the science of ecological restoration), as well as the founding editor of the journal Ecological Restoration (originally: Restoration and Management Notes) and a founding member of the Society for Ecological Restoration, should be the perfect candidate to explain and to justify the processes and goals of ecological restoration. But the equivocation noted above is a warning that the book's main theses are poorly argued and expressed; Jordan's arguments [End Page 97] and presentation do not serve to advance the understanding of restoration as a fundamental and essential task of contemporary environmentalism. On the contrary, the book bolsters the arguments of critics, such as myself, who believe that ecological restoration is a misguided and inappropriate environmental policy.Ecological restoration is the process by which we humans attempt to bring an ecological system (such as a prairie, lake, river, wetland, mountain) back to some prior or original state before it was modified (usually negatively) by human impacts and interventions. Sometimes this means re-creating an entirely new ecosystem that no longer exists; in other cases it means the repair and rehabilitation of damaged ecosystems. Jordan does not, in this book, defend this practice directly. Although he mentions the main anthropocentric benefits that restored systems will maximize (e.g., "rebuilding the ecological capital of soil, air, water, biological diversity, and productivity that is the basis for all human economies" [p. 50] ), his chief interest lies in other directions. He is critical of traditional environmentalism because it has failed "to provide the basis for a satisfactory relationship between culture and nature as it is represented by classic landscapes" (p. 8). Ecological restoration, for Jordan, does provide the basis of this relationship: "Understood not merely as an emergency measure, to be deployed in response to dramatic or acute insults to ecosystems... but as an ongoing process of ecological compensation, restoration quite simply defines the terms of our relationship with natural landscapes, and the terms on which they will survive..." (p. 15).Ecological compensation seems to be the key idea here. When surveying the spectrum from pop psych to neurology in works addressed to general readers, one is struck by how few major figures there have been - certainly when cognitive neuro is compared to a far smaller field (1), evolutionary biology, where real literary talents like Loren Eiseley once flourished, where "media dons" like Richard Dawkins regularly clarify our thinking, where there are magnificent series like those of Stephen Jay Gould (fifteen major essays a year, plus scholarly books and (...) research papers, spanning three decades) which have influenced millions to read more. Many writers in the cognitive spectrum have occasionally written an influential book or two, but few could fill the largest available campus auditorium on name recognition alone, even without announcing a topic for the lecture. This contribution to part 4 of the Common Knowledge symposium “Fuzzy Studies: On the Consequence of Blur” shows how the reputedly radical position that history is not about eternal truths but about the creative construction of a convincing narrative of past events is not an argument of recent vintage. In the days when postmodernism was a technical term used mainly by scholars of art and architecture—and indeed, decades before then—professional historians were grappling with the incapacity of facts to write themselves (...) into a universally satisfying, single version of history. Successive presidents of the American Historical Association such as Andrew Dickson White, Carl Becker, Charles Beard, and William McNeill admitted that writing history is a desperate attempt at pattern recognition in a fuzzy discipline. Pattern recognition is a tool, valuable as a stage in historical thinking, but destined ultimately to come undone. What remains, then, is fuzzy thinking. It can be a good thing, the article concludes, to let our thinking about history remain a blur or, at least, to bear in mind that any patterns we recognize in the past are liable to dissolve under a different light. Abstract:Unlike previous comparisons between Nāgārjuna and the later Wittgenstein, this article denies that either philosophy intends to replace ontological pluralism with holism (see, e.g., Streng 1967, Hudson 1973, Gudmunsen 1974 and 1977, Waldo 1975 and 1978, and Katz 1981). Instead, employing a "therapeutic" reading of the Philosophical Investigations associated with the later Gordon Baker, it is proposed that Nāgārjuna and the later Wittgenstein claim that an ontology consisting of discrete particulars is pictorially indeterminate, visible under either aspect of parts (...) or a whole. What Nāgārjuna and Wittgenstein share is an understanding of contrary positions like pluralism and holism as interchangeable Gestalten rather than matters of fact. As a result, I argue that Nāgārjuna's philosophy may be understood in terms of a broader non-dualism employed as a skill-in-means (upāyakauśalya). Akin to Wittgenstein's notion of an "object of comparison" (PI §131), Nāgārjuna's chief insight amounts to a useful perspective rather than a philosophical thesis. (shrink)

The growing trend of required ethics instruction in the business school curriculum has created a need for relevant teaching materials. In response to this need the Journal of Business Ethics is introducing a new case section.
